Regarding the allegations of financial irregularities being raised against him, Yadav said that in the PTCUL\u2019s \u00a0letter no. 1868 dated 28.06.2023, the following information is to be given in respect of the cases in respect of which points have been raised regarding the investigation in these cases.<\/p>\n Firstly in the suit filed by M\/s Ishan Enterprises in the Hon’ble High Court for appointment as arbitrator, Anil Kumar, Managing Director was not working in PTCUL and took charge of PTCUL on 16-17 December 2021 and shortly after taking charge, the decision in the said case came on 27\/28 December 2021. Therefore, the allegation that objection was to be raised on the application for appointing PTCUL as arbitrator was not possible since during the litigation Anil Kumar Yadav was not working in the PTCUL.<\/p>\n Regarding the case in which a \u00a0FIR registered against M\/s Ishan Enterprises and others regarding work of raising tower near ISBT on Majra- Rishikesh line and Majra- Bindal line and tender pulling, he said that as per PTCUL’s procedure, on receipt of any corporate level tender, all its financial records are sent to the Finance Department and only after their clearance and it\u2019s \u00a0report which is placed before PTCUL\u2019s ‘s Corporate Purchase Committee whose members are Managing Director, Director (Finance) and Director (Project\/Operation) and only after their approval, further processing of tender is done.<\/p>\n There was no comment regarding tender pulling in the tender evaluation report of the Finance Department. Also, the High Court has made the following comment in the writ petition number 489 of 2023 in the case related to tender pulling from PTCUL:-<\/p>\n \u201cThe court further posed questions, as to what offence has been made\u00a0 of if\u00a0 persons give their bids after revealing the bids to each other? What is the offence qua the petitioner? It is the case that it was online bid? Did the petitioner and the co-accused and the other persons made such arrangements that no other person in the world to participate in the bid.? \u201d<\/p>\n The case related to 132 KV Chilla- Najibabad Line \u00a0is not related to the Managing Director. Regarding the IMP Case, it has been mentioned that in the year 2014-16, PTCUL suffered financial loss on the purchase of high loss transformers and the transformers are of low quality. Yadav said that in the year 2014-16, about 18 IMP transformers were purchased and their losses were less than the transformers of equivalent capacity purchased by PTCUL earlier.
