Nainital High Court has clubbed another petition that challenged the provisions of the live in relationships under the newly implemented Uniform Civil Code (UCC) in the state. \u00a0A division bench of Chief Justice G. Narendra and Justice Alok Mahara hearing a petition filed by Jai Tripathi, a 23 year old Dehradun resident issued issuing notice to respondent state and Centre, clubbed it with other petitions challenging the UCC and fixed April 1, 2025 as next date of hearing.<\/p>\n
Arguing on behalf of the petitioner, advocate Abhijay Negi pleaded that mandatory provision of registration of live in relationship under the new law is \u2018institutionalising gossip\u2019.\u00a0 The Chief Justice said that the state has not barred living together. \u201c What gossip? Are you\u00a0 living secretly, in some secluded cave? You are living amongst the civil society. You are living brazenly\u00a0 together without there being a marriage . And then what is the secret? What is the privacy that in Invaded?<\/p>\n
Advocate Negi argued that the privacy of the client is being invaded as he does not wish to declare or register his live in relationship. The bench refuted the argument that the new law does not provide for any declaration and just asking the people to register such relationship. Abhijay negi further argued that a young boy in Almora was killed after having an inter faith marriage. The Chief Justice asked the young lawyer to do some work to enlighten the people.<\/p>\n
Earlier, petitions challenging the provisions of the UCC were heard by the court few days ago and fixed April 1,2025 as next date of hearing. The court meanwhile has assured to hear any infringement of rights arising out of implementation of the new law. The petition by Jammait was argued by senior advocate Kapil Sibal on behalf of of Nainital district President of the outfit Mohammad Muqim of Haldwani,Tazim Ali of Haridwar, Shoeb Ahmed of Nainital, Hafiz Shah Nazar, Abdul sattar and Mustqeem of Dehradun,\u00a0 Advocate Arushi Aggarwal had also challenge certain provisions of the Code while advocate Suresh Singh Negi had challenged the provisions of live in relationships. Sanjay Hegde, senior advocate also appeared in a similar petition filed by Nayeem Quraishy and others of Muslim Sewa Sangathan challenging the new civil code in the state.<\/p>\n
