Dehradun, May 9<\/p>\n

The affiliated unions of All India Defence Employees Federation ( AIDEF) as part of its\u2019 Dehradun declaration at its\u2019 three days 28th National Convention of AIDEF, held here from May 6 to 9, 2026, has taken a serious note of the decision taken by the Government of India to Corporatize the 41 Ordnance Factories by converting the OFB in to 07 DPSU\u2019s, in violation of all the past assurances given by the successive Defence Ministers. The resolution passed at the convention stated that it has been now almost five years after the Corporatization of Ordnance Factories and it has been proved beyond doubt that Corporatization is a failed exercise and has not yielded any positive results.<\/p>\n

The convention took note of the present situation in the Country, especially the difficulties, attacks and challenges being faced by the Defence Civilian Employees and the working class in general, due to the various policy decision taken by the Government of India.<\/p>\n

It was also seriously felt that the Government of India in the Writ Petition filed against the decision of Government to corporatize the Ordnance Factories have given an written assurance before the Hon\u2019ble High Court of Madras with regard to the Service condition of the Defence Civilian Employees of Ordnance Factories who are on deemed deputation. The assurance stated,\u201d \u00a0\u201cIt is humbly reiterated that employees will continue to the Central Government Employees on deemed deputation to the New Corporations unless they themselves opt to get permanently absorbed in these new corporations. Hence, there is no violation of any fundamental right or Article of the Constitution including Article 14 and Article 311\u201d.<\/p>\n

The AIDEF charged that despite the above assurance and also the advance option given by the entire workforce of Ordnance Factories to remain as Central Government Employees \/ Defence Civilian Employees till their retirement the Government has not yet issued a notification.<\/p>\n

The 28th National Convention of AIDEF congratulates and appreciates the position taken by the United Forum of Ordnance Employees to boycott the Absorption Package Meetings and to continue to fight for retaining the status of the Ordnance Factories employees as Central Government Employees \/ Defence Civilian Employees till their retirement from service. The 28th National Convention of AIDEF urges upon the Government of India to withdraw the unilateral decision of Corporatizing the Ordnance Factories and to restore the OFB Status.<\/p>\n

The AIDEF also took a serious note about the ongoing Privatization \/ Outsourcing of permanent and perennial jobs of DRDO, MES, Navy, and other Defence Establishments, abolition of posts in the DGQA based on unrealistic NPC reports which are against the interest of the National Security of our Country. Large number of posts are lying vacant in the Defence Establishments, instead of filling up of these vacancies the Government is resorting to abolition of posts and to outsource all the activities. It\u2019s a matter of serious concern that the Compassionate Ground Appointment is also banned in the Ordnance Factories and Army Units illegally.<\/p>\n

The 28th National Convention of AIDEF oppose all these unfair decisions of the Government and calls upon the Defence Civilian Employees to continue their struggle against all these repressive steps of the Government.<\/p>\n

The reiterated its decision that the contributory NPS & UPS Schemes should be withdrawn and the Defined Non-Contributory Old Pension Scheme should be restored to those employees who are recruited on or after 01.01.2004 as pension is the rights of the Central Government Employees. The 28th National Convention of AIDEF congratulates the Central Government Employees including Defence Civilian Employees who endorsed the call given by AIDEF to reject another Contributory Pension Scheme the UPS which the Government announced with lot of fanfare. The AIDEF will continue and intensify its battle against the NPS & UPS and will not rest till the Non-Contributory Old Pension Scheme is restored to the employees recruited on or after 01.01.2004.<\/p>\n

The 28th National Convention of AIDEF reiterates its position to stand with the entire working class of the Country to oppose the four Anti Worker Labour Codes. These Labour Codes constitute a comprehensive attack on Labour Rights won through more than a century of struggles by the working class. The Labour Codes are meant to weaken the existing Trade Union Rights and also it imposes many restrictions on the right to organize and strike. The IR Code 2020 has kept out the Defence Research Activities from the definition of \u201cIndustry\u201d thereby snatching away the Trade Union Rights from the DRDO employees. The Labour Codes extend working hours, encourage hire and fire, Contractualisation, Fixed Term Employment, Exploitation of Apprentices, dilute Occupational Safety, dismantle inspections, decriminalize the violation of Labour statutes by the employees etc., whereas intensifying repression of workers struggles.<\/p>\n

The Government has totally disregarded Tripartism and has failed to convene the Indian Labour Conference for the last 10 years. The 28th National Convention of AIDEF reiterate that the notification of Labour Codes is a desperate attempt by the Corporates and Capitalist to attack the basic and hard-earned rights of the working class with the ulterior motive to mint more and more profit at the cost of workers.<\/p>\n

The 28th National Convention of AIDEF urges upon the Government of India for denying Trade Union rights to all non-gazette categories such as Chargeman and Office Superintendent, when the Trade Union rights are available to the similar categories of Railways. This is a major discrimination. In accordance with the Hon\u2019ble Supreme Court Judgment and Labour Ministry instructions Hospitals and Educational Institutions are \u201cIndustry\u201d. Despite this Trade Union rights are denied to the Defence Civilian Employees working in Armed Forces Hospitals, Training Institutions and the Defence Civilian Employees working in various Depots under AOC in the name of War Establishment. AIDEF demands that Trade Union rights are extended to the Office Superintendent, Chargeman and also the Defence Civilian Employees of Armed Forces Hospitals and Training Institutions and also to the Defence Civilian Employees working in various Depots under AOC who are denied Trade Union rights in the name of War Establishment.<\/p>\n

The 28th National Convention of AIDEF has also taken a serious note of the increasing litigation in service matters due to the unhelpful attitude of the Authorities and the Government. Employees and their Unions are driven up to the Supreme Court and even after the SLP filed by the Government is dismissed to purchase time and harass the employees, review petitions are also filed in the Supreme Court. Even after all these litigations for years together the decision even of the Apex Court is implemented only for the petitioners and not for similarly placed employees, despite the repeated judgments of the Supreme Court that once a judgment is implemented to the petitioners then the same benefit may be extended to all similarly placed employees. The 28th National Convention of AIDEF urges upon the Government of India to dispense with this unfair labour practice and implement all Court judgments given in favour of the employees to all similarly placed employees to avoid multiplicity of litigation on the same issue which are already settled by law.<\/p>\n

The 28th National Convention of AIDEF is very much concerned about the unhelpful attitude of the Authorities in the Ministry of Defence in not settling the outstanding demands of the Defence Civilian Employees working in Ordnance Factories, MES, DRDO, Navy, EME, Air Force, AOC, DGQA, DGAQA, DGAFMS and also of the Defence Civilian Employees of Armed Forces Hospitals including Military Hospitals, Supply Depots and Training Centers etc. The AIDEF urges upon the Ministry of Defence to immediately settle all the demands placed by AIDEF by holding meetings and to reach an amicable settlement.<\/p>\n

The 28th National Convention took serious note that the Government of India has completely made the JCM Scheme defunct by not holding the meetings of the Departmental Council (JCM) for the past more than 10 years. Meetings of the Additional Meeting Mechanism is also not taking place as per its Constitution. The 28th National Convention of AIDEF has also noted that the JCM and other Industrial Relation Machineries in the Railways are functioning effectively. The AIDEF urges upon the Defence Ministry that the JCM Scheme and all the Industrial Relation Machineries of the Ministry of Defence may be strengthened.<\/p>\n

The 28th National Convention of AIDEF protest against such unfair and unhelpful attitude of the Ministry of Defence and demands that the JCM forum and the Additional Meeting Mechanism may be strengthened and activated.<\/p>\n

The 28th National Convention of AIDEF fully endorsed the Memorandum submitted by the Staff Side of National Council (JCM) on common service matter of Central Government Employees and also the Memorandum submitted by AIDEF on the Cadre Related issues and other issues pertaining to the Defence Civilian Employees to the 8th Central Pay Commission.<\/p>\n

The AIDEF urges upon the 8th CPC to give due importance and weightage to the demands \u00a0submitted by the Staff Side of National Council (JCM) and AIDEF and recommend accordingly to the Government of India including the demands of the Pensioners.<\/p>\n

The Convention also asserted that the attacks on the Government Defence Industries, on the Defence Civilian Employees will be resisted by the Defence Civilian Employees through its various protest programs. The agitations so far observed by the Defence Civilian Employees on the call of AIDEF represents a decisive assertion of the collective will of the Defence Civilian Employees to defend the Government Defence Industry, to defend their rights and to achieve more rights and benefits.<\/p>\n

The 28th National Convention of AIDEF called upon on all its affiliated Unions to start preparations for mobilizing the employees against the Anti Worker Policies being adopted by the Government. The 28th National Convention of AIDEF reminds the Defence Civilian Employees that the ongoing battle is a fight which we should win and we cannot afford to lose.<\/p>\n

The Convention resolved to launch a determined resistance to fight relentlessly against Corporatization, Privatization, Contractorization, Outsourcing, Fixed Term Employment and to seek publication of notification to retain the services of the Defence Civilian Employees of 41 Ordnance Factories as Central Government Employees till their retirement as assured by the Government in the Hon\u2019ble High Court of Madras in the Writ Petition filed by AIDEF.<\/p>\n

It was also decided to fight against the contributory NPS & UPS and to restore the non-contributory Old Pension Scheme, to scrap the four Anti-Worker Labour Codes and to withdraw the draconian provision of exempting Defence Research Activities from the definition of \u201cIndustry\u201d, filling up all the vacancies through Permanent employment to regularize the service of all the Casual Contract and Fixed Term Employees, to lift the ban on compassionate appointment, to achieve all the demands through the 8th CPC, to activate the JCM Scheme and all Industrial Relations Machinery in the Defence Ministry, to implement all Court Judgments given in favour of the employees and avoid multiplicity of litigations.<\/p>\n","protected":false},"excerpt":{"rendered":"
