Pithoragarh, Oct 6:

Pithoragarh District and Sessions Judge Dhananjay Chaturvedi today sentenced two men from Lucknow, Uttar Pradesh, to two years’ imprisonment each and imposed a fine of Rs 20,000 each for fraudulently cheating an investor of Rs 26 lakh through the Pithoragarh branch of their investment company, ‘Aadhar Multiple Pithoragarh Central Nidhi Limited’, in 2020.

Rakesh Chand, District Government Counsel (Civil), Pithoragarh, said that the convicts, Abhay Srivastava and Deepak Srivastava, had cheated the investor by misappropriating the deposited amount.

According to the judgment, the two convicts will have to undergo an additional two months in jail if they fail to pay the fine of Rs 20,000 imposed on each of them.

The court convicted them under Sections 406, 409 and 420 of the Indian Penal Code (IPC) and Section 3 of the Uttarakhand Protection of Interests of Depositors (in Financial Establishments) Act, 2000, the DGC said.

“This is the first such case in Pithoragarh district in which a judgment has been delivered under the UPID Act,” Chand said, adding that the court pronounced the judgment after hearing the case filed by the victim, Purnima Thapa, who had lodged a complaint of fraud with Pithoragarh police on February 12, 2020.

The court also imposed a fine of Rs 2 lakh on Aadhar Multiple Pithoragarh Central Nidhi Limited, the DGC said.
