Court orders against former Pithoragarh SP

Sanjay Singh, Chief Judicial Magistrate, Pithoragarh has ordered the police station, Pithoragarh to lodge an FIR against former Superintendent of Police (SP), Pithoragarh Lokeshwar Singh, under sections, 323,242,355,504,506,392 and 120B and ensure investigation into the matter in an order on April 7 .
The incident in question occured on February 6, 2023 in which an RTI activist and trader Laxmi Datt Joshi had complained of his physical beating to the State Police Complaints Authority, that in turn found the SP responsible for the assault in the matter and ordered the police to take action.
“But despite repeated attempts, Pithoragarh police did not lodged the complaint forcing me to move the court to get justice,” said tbe councel of Laxmi Datt Joshi, the victim.
“The order came after court has accepted the case lodged by Laxmi Datt Joshi, a businessman of Pithoragarh town on later’s application under section 175(3) of Indian Citizen’s Protection Act 2023,” said Ashish Harward, counsel of the applicant.
The case is related with beating of Laxmi Datt Joshi by the then SP Lokeshwar Singh, in February 2023, when he had gone to police to lodge an application requesting the police to stop, flowing sewer from police family quarters as that was flowing on the road and other establishments around.
“My client was taken to SP office where the SP and other police personnels striped the victim and beat him mercilessly,” said Ashish Harward, counsel for Joshi.
Pithoragarh police circle officer, Govind Ballabh Joshi, has said that he has not received the judgement copy yet.” On receiving the copy, the action will be taken according to the orders of the court,” said tbe CO.
Lokeshwar Singh, a former IPS, has since resigned from police service on November 28, 2024 and has joined an organisation of United Nations.
